Prize Competition Terms and Conditions for SuperDraw

These terms comply with the UK Gambling Act 2005, CAP Code and Maltese legislation

1. Definitions and Interpretation

In these Terms and Conditions, unless the context otherwise requires:

  • "Promoter" or "We" or "Us" means Option Solutions, a company registered in Malta with registered address at 60, Tower Road, Sliema, Malta (VAT NR: MT21536403, TAX ID: 996430626).
  • "SuperDraw" or "Platform" means the website and mobile applications operated at superdraw.io and associated domains.
  • "Competition" or "Draw" means any prize competition or prize draw operated through the Platform.
  • "Entry" means a valid entry into a Competition, whether via paid or free route.
  • "Participant" or "You" means any person who enters a Competition.
  • "Prize" means any prize offered in a Competition as described in the Competition listing.
  • "Free Entry Route" means the no-purchase-necessary postal entry method available for all Competitions.
  • "Closing Date" means the date and time after which no further entries will be accepted for a Competition.
  • "Draw Date" means the date on which the winner(s) will be selected.

2. Eligibility

To enter our Competitions, you must:

  • Be 18 years of age or older at the time of entry.
  • Be a resident of the United Kingdom, European Union, or other jurisdiction where participation is legal.
  • Have legal capacity to enter into binding contracts.
  • Comply with all applicable laws in your jurisdiction.

The following persons are NOT eligible to enter:

  • Employees, officers, and directors of the Promoter and their immediate family members.
  • Employees of any company involved in the administration or provision of prizes for the Competition.
  • Any person who has been banned or self-excluded from the Platform.
  • Residents of jurisdictions where participation in prize competitions is prohibited by law.

We reserve the right to require proof of age and identity before awarding any Prize. Failure to provide such proof within 14 days of request will result in forfeiture of the Prize.

3. How to Enter

There are TWO ways to enter our Competitions, both with EQUAL chance of winning:

Method 1: Online Entry (Payment Required)

  • Visit the Competition page on our Platform.
  • Select the number of entries you wish to purchase.
  • Complete payment via our secure payment provider.
  • Each entry costs the amount specified on the Competition page.
  • You will receive email confirmation of your entry/entries.

Method 2: Free Postal Entry (No Purchase Necessary)

NO PURCHASE NECESSARY. You may enter for FREE by post. Free entries have the SAME chance of winning as paid entries.

  • Your postal entry MUST include:
    • Your full name.
    • Your complete postal address including postcode.
    • Your telephone number.
    • Your email address (if available).
    • The exact name of the Competition you wish to enter (as shown on the Platform).
    • Note: Each postcard provides exactly 1 entry. Send multiple postcards for multiple entries.
  • Each postcard provides exactly 1 entry to the Competition. Send multiple postcards for multiple entries.
  • Postal entries must be received BEFORE the Closing Date (postmark date is not sufficient).
  • Allow 5-7 working days for postal delivery when planning your entry.
  • We recommend using proof of postage but cannot accept responsibility for lost mail.

Important:

  • Free postal entries are treated EXACTLY the same as paid entries in the Draw.
  • There is NO discrimination or disadvantage to using the free entry method.
  • The selection process is completely random and does not distinguish between entry methods.
  • Postal entry costs you only the price of normal postage.

4. Entry Restrictions and Validation

  • Multiple Entries: You may purchase or submit multiple entries to the same Competition unless specifically restricted on the Competition page. Each entry will be treated separately in the Draw.
  • Maximum Entries: Unless otherwise stated, there is no maximum limit on entries per person. However, we reserve the right to reject entries we reasonably believe constitute abuse of the system.
  • One Entry Per Transaction: Each paid transaction or postal submission counts as one or more entries as specified.
  • Closing Dates: All entries must be received before the published Closing Date and time. Late entries will not be accepted under any circumstances.
  • Incomplete Entries: Entries that do not contain all required information (postal entries) or do not complete payment (online entries) will be invalid.
  • Fraudulent Entries: Any attempt to enter by fraudulent means, use of automated systems, or manipulation of the entry process will result in immediate disqualification and potential legal action.
  • Bulk Entries: We reserve the right to reject bulk entries from a single source that we reasonably believe are not genuine individual entries.
  • Modification: Once submitted, entries cannot be modified or withdrawn except as required by law.

We reserve the right to verify the validity of all entries and to disqualify any Participant who:

  • Tampers with the entry process.
  • Submits an entry that is not in accordance with these Terms.
  • Engages in conduct that is fraudulent, misleading, or potentially damaging to the Promoter.
  • Acts in a way that is harassing or abusive to our staff or other Participants.

5. The Draw and Selection Process

Our Competitions are conducted with complete fairness and transparency:

  • Random Number Generation: Winners are selected using a certified cryptographically secure random number generator (RNG) that ensures complete fairness and unpredictability.
  • Draw Date: The Draw will take place on or shortly after the Closing Date as specified on the Competition page. The exact date and time may vary but will not exceed 48 hours after the Closing Date.
  • Equal Treatment: All valid entries, whether paid or free postal entries, are entered into the same pool and have exactly equal probability of being selected.
  • Supervision: All Draws are conducted under the supervision of the Promoter's management to ensure fairness and compliance.
  • Recording: We maintain records of all Draws including timestamp, entry pool size, and winning entry details for audit purposes.
  • Verification: Before any Prize is awarded, we verify that the winning entry was valid and that the winner meets all eligibility criteria.
  • Reserve Winners: We may draw reserve winners who will be contacted if the primary winner(s) cannot be validated or does not claim their Prize.
  • Minimum Entries: We reserve the right to cancel a Competition if a minimum number of entries is not received. If cancelled, all entry fees will be fully refunded.

Transparency Commitment:

We are committed to operating all Competitions fairly and in compliance with the UK Gambling Act 2005 and the CAP Code. Our selection process ensures that success is determined purely by chance and that all Participants have a fair and equal opportunity to win.

6. Prizes

Prize Details:

  • Each Competition will clearly state the Prize(s) available, including description, quantity, and estimated retail value.
  • Prize values stated are approximate and based on recommended retail prices at the time of listing.
  • Prizes are as described on the Competition page and may include physical goods, cash, gift cards, vouchers, or experiences.
  • Prizes are not transferable and cannot be exchanged for cash unless specifically stated as a cash Prize or cash alternative.

Cash Alternative:

  • Unless specifically stated on the Competition page, there is no cash alternative to non-cash Prizes.
  • Where a cash alternative is offered, it will be clearly stated on the Competition page and will be a percentage of the stated Prize value.

Prize Substitution:

  • We reserve the right to substitute a Prize with another of equal or greater value if the advertised Prize becomes unavailable for reasons beyond our reasonable control.
  • Where substitution is necessary, we will contact the winner to agree on a suitable alternative.
  • If the winner does not accept the substitute Prize, it will be deemed forfeited and we may award it to a reserve winner.

Taxes and Additional Costs:

  • All Prizes are awarded "as is" and include only what is specifically stated in the Prize description.
  • Winners are responsible for any taxes, insurance, registration fees, or other costs associated with accepting, owning, or using the Prize.
  • For high-value Prizes (over £500), winners may be required to provide tax information as required by HMRC regulations.
  • Where applicable, we will provide winners with documentation of Prize value for tax purposes.

Warranty and Liability:

  • Physical Prizes are subject to manufacturer's warranty only. The Promoter provides no additional warranty.
  • The Promoter is not responsible for any defects in Prizes beyond ensuring they are as described.
  • Winners should direct any warranty claims to the manufacturer directly.

7. Cancellation and Refunds

7.1. Due to the nature of the competitions, where entries are processed immediately and digital tickets are issued upon purchase, all entries are final. No refunds of the entry fee will be given under any circumstances, including, without limitation, where:

  • (a) You change your mind after purchasing an entry.
  • (b) You are found to be ineligible to enter or win the competition.
  • (c) You are disqualified for breaching these terms and conditions.

7.2. By purchasing an entry, you expressly request that the service (the entry into the competition) begins immediately. You acknowledge and agree that your statutory 14-day right to cancel (the "cooling-off period") under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply once the service has started.

7.3. If the Merchant (SuperDraw) is required to cancel a competition for any reason, a full refund of the entry fee or a credit of equal value will be provided to the customer.

7. Winner Notification and Verification

Notification Process:

  • Winners will be notified within 48 hours of the Draw Date.
  • Notification will be sent via:
    • Email to the registered email address (for online entries).
    • Email and/or telephone for postal entries.
    • Announcement on the Platform (surname and county only).
  • It is the Participant's responsibility to ensure contact details are accurate and up to date.
  • We are not responsible if you do not receive notification due to incorrect contact details or spam filters.

Verification Requirements:

  • Winners must respond to our notification within 14 days.
  • Winners must provide proof of identity (valid photo ID such as passport or driving licence).
  • Winners must provide proof of address (dated within last 3 months).
  • Winners must provide proof of age (if not evident from photo ID).
  • Winners must sign and return a Winner Declaration Form confirming:
    • Eligibility and compliance with these Terms.
    • Agreement to Prize delivery terms.
    • Consent to winner announcement (or objection with reasons).
    • Agreement to publicity use (if applicable – winners may decline).

Unclaimed Prizes:

  • If a winner does not respond within 14 days of notification, the Prize will be deemed forfeited.
  • If a winner cannot be verified or does not meet eligibility requirements, the Prize will be forfeited.
  • Forfeited Prizes will be awarded to the next valid reserve winner drawn.
  • If all reserve winners also forfeit, the Prize may be:
    • Rolled over to a future Competition (with announcement).
    • Donated to a registered charity (with public notice).
    • Retained by the Promoter (only if value is under £100).

Important:

Check your email (including spam folder) regularly after entering a Competition. Ensure your contact details are correct. We cannot re-award Prizes that were forfeited due to failure to respond or provide required verification.

8. Winner Announcement and Publicity

Public Winner Announcement:

In accordance with the CAP Code requirements, we will publish information about Competition winners to demonstrate that valid awards have taken place.

  • We will publish the winner's surname and region/country on:
    • The SuperDraw Platform (Winners page).
    • The specific Competition page.
    • Our social media channels (as applicable).
  • Publication will occur within 7 days of Prize acceptance.
  • Winner information will remain published for a minimum of 90 days.

Your Rights Regarding Publication:

  • Before entering any Competition, you are notified that winner information will be published as described above.
  • You have the right to object to publication of your details by notifying us at the time of your win.
  • If you object, we may:
    • Publish reduced information (e.g., first initial and county only).
    • Require you to agree to verification by an independent third party.
    • In exceptional cases, withhold the Prize pending resolution.
  • This publication is separate from any publicity or promotional use of your name or image.

Additional Publicity (Optional):

  • We may invite winners to participate in additional publicity (photos, interviews, testimonials).
  • Participation in additional publicity is ENTIRELY VOLUNTARY.
  • You may decline any publicity requests without affecting your Prize.
  • If you agree to publicity, we will ask you to sign a separate Publicity Release Form.
  • You may set limits on how your image/name is used and for how long.

Data Protection:

All winner announcements are made in accordance with EU GDPR and our Privacy Policy. We have a legitimate interest in publishing winner information to demonstrate the integrity of our Competitions, balanced against your privacy rights as described above.

9. Prize Delivery and Fulfillment

Delivery Timelines:

  • Cash Prizes: Transferred to winner's bank account via SEPA or international transfer within 5–10 working days of verification.
  • Digital Prizes (Gift Cards, Vouchers): Sent via email within 24–48 hours of verification.
  • Physical Prizes: Dispatched within 14 days of verification (delivery times vary by location, typically 3–10 working days).
  • Experience Prizes: Winner will be contacted to arrange booking within 7 days of verification. Must be redeemed within validity period stated in Prize description.

Delivery Methods:

  • Physical Prizes will be sent via insured, tracked courier service for Prizes valued over £100.
  • Prizes valued under £100 may be sent via Royal Mail Tracked or similar service.
  • International delivery may incur additional time and winners are responsible for any customs duties or import taxes.
  • Winners will be provided with tracking information for physical Prizes.
  • Delivery address must be verified and cannot be changed after dispatch.

Delivery Issues:

  • Winners must notify us within 5 working days if a Prize is not received when expected.
  • Winners must notify us within 48 hours if a Prize is received damaged or defective.
  • We will investigate and arrange replacement or refund at our discretion.
  • We are not liable for delays caused by couriers, customs, or circumstances beyond our reasonable control.
  • If a Prize cannot be delivered after reasonable attempts, it may be forfeited.

Acceptance of Prize:

  • By accepting a Prize, winners agree to these Terms and any specific terms attached to the Prize.
  • Winners may decline a Prize, in which case it will be offered to a reserve winner.
  • Once accepted and delivered, Prizes cannot be returned to the Promoter (except as required by consumer protection law).

Prize Collection:

Some high-value Prizes may require collection in person or special arrangement. If so, this will be clearly stated in the Competition terms and we will work with winners to arrange convenient collection.

10. Data Protection and Privacy

We are committed to protecting your personal data in accordance with the EU General Data Protection Regulation (EU GDPR) and Maltese data protection legislation.

Data Controller:

Option Solutions is the data controller for personal data collected through our Competitions.

Personal Data Collected:

  • Name and contact details (email, phone, postal address).
  • Payment information (processed securely by our payment provider).
  • Entry details and Competition preferences.
  • Identity verification documents (for winners only).
  • IP address and device information (for fraud prevention).
  • Communication records (customer service, winner notification).

Lawful Basis for Processing:

  • Contract Performance: Processing entry, conducting Draws, and awarding Prizes.
  • Legal Obligation: Age verification, tax reporting, anti-money-laundering checks.
  • Legitimate Interests: Fraud prevention, winner announcement (balanced against your rights), service improvement.
  • Consent: Marketing communications (you can opt out at any time).

Data Retention:

  • Entry data — retained for 90 days after Competition end date or until all Prizes are awarded.
  • Winner data — retained for 6 years for tax and legal compliance purposes.
  • Account data — retained while your account is active plus 3 years of inactivity.
  • Marketing data — retained until you withdraw consent.

Your Rights:

  • Right to access your personal data.
  • Right to rectification of inaccurate data.
  • Right to erasure (“right to be forgotten”) subject to legal retention requirements.
  • Right to restrict processing.
  • Right to data portability.
  • Right to object to processing (including marketing).
  • Right to withdraw consent.
  • Right to lodge a complaint with the Information Commissioner’s Office (ICO).

Data Sharing:

  • Payment processors – for payment processing only.
  • Delivery/courier services – for Prize fulfillment only.
  • Prize suppliers – as necessary to fulfill specific Prizes.
  • Legal/regulatory authorities – when required by law.
  • Professional advisors – under confidentiality obligations.

11. Responsible Participation

While our Competitions are prize draws and not gambling in the traditional sense, we are committed to promoting responsible participation and protecting vulnerable individuals.

Our Commitment:

  • 18+ Only: Strict age verification for all Participants.
  • Spending Limits: Maximum daily spend limit of £1,000 per account.
  • Self-Exclusion: Participants can request temporary or permanent account suspension.
  • Cooling-Off Periods: Option to set breaks from participation (24 hours to 6 months).
  • Support Information: Links to problem-gambling support organizations.
  • No Credit: We do not offer credit or “buy now, pay later” options for entries.

Healthy Participation Guidelines:

  • Only participate with money you can afford to spend on entertainment.
  • Set a budget and stick to it.
  • Don't try to win back losses.
  • Take regular breaks.
  • Don't participate when stressed, upset, or under the influence.
  • Remember: Competitions are entertainment, not a way to make money.

12. Limitation of Liability and Disclaimers

Force Majeure:

We are not liable for any failure to perform our obligations under these Terms if such failure is caused by circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (natural disasters, severe weather).
  • War, terrorism, civil unrest.
  • Government restrictions or regulations.
  • Pandemics or epidemics.
  • Strikes, labor disputes.
  • Failure of suppliers, carriers, or third-party service providers.
  • Power failures, internet outages, technical failures.
  • Unavailability of Prizes due to discontinuation or supply chain issues.

Right to Modify or Cancel:

  • We reserve the right to cancel, suspend, or modify any Competition if circumstances arise that make it impractical or unlawful to continue.
  • If a Competition is cancelled before the Draw, all entry fees will be refunded.
  • If a Competition is cancelled after the Draw but before Prize delivery, we will fulfill Prize obligations unless impossible due to force majeure.
  • We will notify all Participants of any cancellation or material modification via email and Platform announcement.

Liability Limitations:

To the fullest extent permitted by law:

  • Our total liability to you for any Competition shall not exceed the total entry fees you paid for that specific Competition.
  • We are not liable for any indirect, consequential, special, or punitive damages.
  • We are not liable for loss of profits, revenue, business, or opportunity.
  • We are not liable for disappointment, distress, or other non-economic loss.
  • We are not liable for Prize defects or quality (manufacturer warranties apply).
  • We are not liable for tax consequences of winning a Prize.

Exceptions:

Nothing in these Terms shall exclude or limit our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any liability that cannot be excluded by Maltese or EU law.

Your Statutory Rights:

These Terms do not affect your statutory rights as a consumer under Maltese law and EU consumer protection regulations.

Platform Availability:

  • We do not guarantee that the Platform will be available 100% of the time.
  • We may suspend access for maintenance, updates, or technical issues.
  • We are not liable for any inability to enter a Competition due to Platform unavailability, provided we act reasonably to restore service.
  • If Platform unavailability prevents entry, we may extend the Closing Date at our discretion.

Software Errors and Prize Suspension:

We reserve the right to temporarily suspend Prize awarding if technical errors or software bugs may have affected Competition results. We will:

  • Notify affected winners immediately
  • Investigate the error within 14 working days
  • Either award the Prize if the result was correct, or refund entry fees and conduct a new draw if the error affected the outcome

Our liability is limited to refunding entry fees for the affected Competition. This does not affect your statutory consumer rights.

13. Complaints and Dispute Resolution

How to Complain:

If you are unhappy with any aspect of our Competitions or service, please contact us:

  • Subject Line: "Competition Complaint – [Competition Name]".

Our Complaints Process:

  1. We will acknowledge your complaint within 2 working days.
  2. We will investigate your complaint thoroughly and impartially.
  3. We will provide a full written response within 14 days (or explain why we need more time).
  4. If you remain dissatisfied, you may request escalation to senior management.
  5. Escalated complaints will receive a final response within 28 days.

Independent Review:

If you are not satisfied with our final response, you may refer your complaint to:

  • The Advertising Standards Authority (ASA):
    • www.asa.org.uk/make-a-complaint.html
    • The ASA regulates advertising and promotional marketing (including prize competitions) under the CAP Code.
  • Citizens Advice Consumer Service:
    • Phone: 0808 223 1133.
    • www.citizensadvice.org.uk/consumer/
  • Alternative Dispute Resolution (ADR):
    • We may agree to use an approved ADR provider for certain disputes.
    • ADR is voluntary and not binding unless both parties agree.

Legal Action:

  • These Terms are governed by the laws of Malta.
  • Any legal disputes will be subject to the exclusive jurisdiction of the courts of Malta.
  • As a consumer, you may also bring proceedings in the courts of your country of residence in accordance with EU regulations.

Our Decision is Final:

Subject to your legal rights and the above complaint mechanisms, our decision on all matters relating to Competitions (including interpretation of these Terms, eligibility, entry validity, and winner selection) is final and binding.

14. General Terms

Acceptance of Terms:

  • By entering any Competition, you agree to be bound by these Terms and Conditions.
  • You also agree to be bound by any specific rules stated on the individual Competition page.
  • If there is any conflict between these Terms and Competition-specific rules, these Terms take precedence unless explicitly stated otherwise.

Modification of Terms:

  • We may update these Terms from time to time to reflect legal, regulatory, or operational changes.
  • The version of the Terms in effect at the time you enter a Competition will govern your entry.
  • Material changes will be notified via email to registered users and posted on the Platform.
  • Continued use of the Platform after changes constitutes acceptance of modified Terms.
  • We will not modify the terms of a Competition after its Closing Date.

Severability:

  • If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be deemed severed.
  • The remaining provisions shall continue in full force and effect.
  • The invalid provision shall be replaced with a valid provision that most closely matches the intent of the original.

Waiver:

  • Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Any waiver must be in writing and signed by an authorized representative of the Promoter.

Entire Agreement:

  • These Terms, together with our Privacy Policy and any Competition-specific rules, constitute the entire agreement between you and the Promoter.
  • They supersede all prior agreements, understandings, and representations.

No Assignment:

  • You may not assign or transfer your rights or obligations under these Terms.
  • We may assign our rights and obligations to a successor entity in the event of a merger, acquisition, or sale of assets.

Third Party Rights:

  • These Terms are between you and the Promoter only.
  • No third party has any right to enforce any provision of these Terms under the Contracts (Rights of Third Parties) Act 1999.

Language:

  • These Terms are provided in English.
  • If we provide a translation, the English version shall prevail in the event of any conflict or ambiguity.

Governing Law and Jurisdiction:

  • These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by the laws of Malta.
  • Any disputes shall be subject to the exclusive jurisdiction of the courts of Malta.
  • If you are a consumer in another EU member state, you may bring proceedings in the courts of your country of residence.
  • As a consumer, you have additional rights under EU consumer protection regulations.

15. Regulatory Compliance and Standards

Legal and Regulatory Framework:

Our Competitions are operated in compliance with:

  • Gambling Act 2005 (UK): Our Competitions are structured as prize competitions with a free entry route and are therefore not lotteries requiring a gambling license.
  • CAP Code (Committee of Advertising Practice): We comply with all rules for promotional marketing, particularly Section 8 (Promotional Marketing) including Rules 8.17, 8.18, 8.23, and 8.28.
  • Malta GDPR and Data Protection Act: We process personal data lawfully, fairly, and transparently.
  • Maltese Consumer Law: We ensure fairness and transparency in all consumer transactions.
  • Maltese Consumer Protection: We do not engage in misleading or aggressive commercial practices.
  • Maltese E-Commerce Legislation: We provide all required information for online transactions.

CAP Code Compliance:

Specific compliance with CAP Code requirements:

  • Rule 8.2: Promotions are conducted equitably, promptly, and efficiently.
  • Rule 8.14: Free entry route is promoted as prominently as paid route.
  • Rule 8.17: All significant conditions clearly communicated (as detailed throughout these Terms).
  • Rule 8.20: Winners can be verified and we publish winner information.
  • Rule 8.24: Competitions are conducted under proper supervision with adequate resources.
  • Rule 8.28: All required information available before entry (how to enter, restrictions, Prize details, etc.).

Fair Trading:

  • We do not make misleading claims about Prize values, odds, or Competition terms.
  • We honor all Prizes as described.
  • We operate transparently and provide clear information at all stages.
  • We treat all Participants fairly and equally.

Reporting and Accountability:

  • We maintain detailed records of all Competitions for regulatory and audit purposes.
  • We cooperate fully with any regulatory investigations or inquiries.
  • We report any suspected illegal activity to appropriate authorities.
